Terms and Conditions

PURPOSE
The purpose of these Terms and Conditions is to regulate the commercial relationship between ROOM00 HOSTELS & HOTELS S.L.U., depending on the hotel where the reservation is made (hereinafter referred to as “Room00 Group”), and its customers (hereinafter referred to as the “Customer”). Room00 Group owns, operates, and manages a series of properties under its brands Letoh, Select, TOC, Room00, as well as a series of websites and applications to receive, manage, and accept hotel reservations (its “Websites”), also through the website of Room00 Group’s reservation service providers (hereinafter referred to as the “Providers’ Website”). These Terms and Conditions, as well as all legal texts, such as the Privacy Policy, Legal Notice, and Cookie Policy, establish the contract between the Parties (collectively referred to as the “Conditions”).

CHARACTERISTICS OF THE SERVICES
Room00 Group, through its Websites, as well as through third-party reservation service providers, provides accommodation reservation services (hereinafter referred to as the “Accommodation/s”), through which the Customer may book rooms in hotels or other types of accommodation managed by Room00 Group (hereinafter referred to as the “Services”).

3. RESERVATION CONDITIONS
To be able to book an Accommodation with Room00 Group, the Customer must be of legal age.
When the Customer wishes to book an Accommodation with Room00 Group, they must follow the following steps:
· Enter the search criteria: the Customer must provide Room00 Group or the reservation service providers with the reservation details in order to determine whether Accommodation is available. Among other details, the Customer must specify the dates and the number of people who wish to book the Accommodation with Room00 Group. If no availability exists according to the requested conditions, the Customer must enter the search criteria again according to their preferences in order to book an available Accommodation.
· Select the room type: if Accommodation is available, the Customer must indicate the type of Accommodation they prefer in order to make the reservation.
· Additional services: together with the Accommodation reservation, the Customer must indicate whether they wish to book additional services, such as breakfast service, cancellation services, Accommodation amenities, among others.
· Payment: once the room and additional services have been selected, the Customer shall proceed with the payment of the Services. 
Once the payment for the Services has been made, the Customer will receive an email confirming the Accommodation reservation for the dates and according to the conditions provided to Room00 Group.

4. PAYMENT PROCEDURE
The Customer may contract the Services of Room00 Group through the payment procedure provided on the Room00 Group Websites or those of its reservation service providers. Once this procedure has been completed, the Customer must accept these Conditions, which will establish a general framework for the contractual relationship between the parties.
Once the Conditions have been accepted, the Customer shall pay the price of the Services through the payment gateway contracted by Room00 Group.
Any contracted Service may be rejected or cancelled by Room00 Group when there is an obvious error in the price or in the information regarding the services, or when the billing and/or payment details are insufficient or inaccurate. Services may also be cancelled if there are reasonable grounds to suspect that they have been made using stolen billing information, appear to be related to fraud, or are connected to a previous payment dispute.

5. PRICES
The prices of Room00 Group’s Services shall be those defined at any given time on its Websites and/or those indicated on the webpages of its accommodation service providers, depending on the Website through which the Customer contracts the Services.
The amounts paid by the Customer for the contracting of the Services shall not be refundable, except if the Customer has expressly booked the free cancellation option for the Services, which shall apply in accordance with the conditions established for each specific case.
Room00 Group reserves the right to modify the prices indicated on its Websites, without such changes affecting the Services already contracted or those being provided at the time of the price change.
The price indicated on the Room00 Group Websites or those of its reservation service providers does not include local accommodation taxes, which, if applicable, must be paid at the Room00 Group Accommodations.

6. RIGHT OF WITHDRAWAL (CANCELLATION POLICY)
The User acknowledges and accepts that, once the Services have been contracted, Room00 Group shall not be required to provide them with a right of withdrawal, pursuant to the provisions established in the applicable consumer regulations, as the exception set out in Article 103.L of the consolidated text of the General Law for the Defence of Consumers and Users (“TRLGDCU”) applies.
In this way, as a general rule, the early cancellation of the Services shall not entitle the Customer to a refund of the price paid for such Services by Room00 Group. Without prejudice to the foregoing, the Customer may only cancel the Services in advance if they have contracted cancellation services, which shall apply in accordance with the conditions agreed upon in each specific case.

7. CUSTOMER OBLIGATIONS
When contracting the Services of Room00 Group:
a) The Customer shall provide Room00 Group with the information required for the provision of the Services. All information provided by the Customer must be truthful, accurate, and lawful. Room00 Group shall not be liable when the Customer provides incorrect or fraudulent information.
b) The Customer shall use the Services in compliance with the applicable regulations and these Conditions, as well as in accordance with good faith and public order rules. In the event that the Customer fails to comply with their obligations under these Conditions, they shall be liable for any damages caused by them to Room00 Group or to third parties.
c) The Customer shall pay the price of the contracted Services in accordance with the conditions established in each case:
a. Any reservation or payment that is irregular, ineffective, incomplete, or fraudulent for any reason attributable to the Customer shall result in the cancellation of the Service reservation, without prejudice to any other actions that Room00 Group may take against them;
b. Room00 Group reserves the right to remove the Customer from the Accommodation during the provision of the Services and before their completion, without the right to compensation or a refund, when the Customer’s behaviour is contrary to good faith and public order within the Accommodation. In the event that the price has not been paid, the Customer must pay the price of the Services before leaving the Accommodation.
d) The Customer shall respect the Accommodation’s rules of coexistence at all times and shall make proper use of its furniture and contents.

8. TERM
These Conditions shall be valid from the moment the Customer contracts the Services until the completion of the same.

9. LIABILITIES
Room00 Group has made every effort to ensure that the information on its Websites is accurate and up to date. However, Room00 does not guarantee nor shall it be held responsible for the accuracy and updating of the contents of its Websites. Room00 Group shall not be liable for any errors or omissions in the contents of its Websites or the Providers’ Website and reserves the right to modify such contents at any time.
Room00 Group shall not be liable for errors or malfunctions in its Websites, whether inherent or due to the characteristics and limitations of the Internet, nor for those affecting the Providers’ Website. The Customer assumes any risk arising from the use of the Internet, including the possible transmission of computer viruses. Room00 Group does not guarantee the uninterrupted operation of the services provided through its Websites or the Providers’ Website and shall not be liable for any damages that may arise from the interruption of the Services. In particular, Room00 Group shall not be liable in cases of force majeure, such as fires, strikes, power supply outages, or any other unforeseeable or unavoidable events, nor for the improper use of its Websites by the Customer in accordance with these Conditions.
In any case, Room00 Group shall only be liable for damages that were foreseen or could have been foreseen at the time the Customer used its Websites, and which are a direct and necessary consequence of a breach, due to gross negligence, of substantial contractual obligations. The fact that its Websites and/or the Providers’ Website describe or present certain services does not imply a commitment by Room00 Group that such services will be available to the Customer.
The exclusion of liabilities and warranties described in this section shall apply both to Room00 Group and to its administrators, managers, employees, and representatives.

10. WARRANTIES
Room00 Group guarantees that the Services will substantially comply with the characteristics and description set out in these Conditions.  
Room00 Group does not guarantee that the Services will be uninterrupted or error-free for a specific purpose. In any case, the Customer has the right for the Services to be of satisfactory quality and to comply with their description.  
Except for the express warranties described in this section, and to the maximum extent permitted by mandatory applicable legislation, the Services and any technology or access thereto provided by Room00 Group pursuant to these Conditions are provided “as is”, and Room00 Group does not provide any type of warranty, whether express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose.   
If the Customer considers that the services received do not comply with the minimum characteristics established in this document, they may notify Room00 of this circumstance through the communication channels provided in these Conditions.   

11. INTELLECTUAL PROPERTY RIGHTS
The Customer expressly acknowledges that Room00 Group is the owner of the industrial and intellectual property rights of its Websites. Therefore, it is expressly understood that these Conditions do not grant the Customer any intellectual property rights over them, except those expressly recognised herein. The Customer may not use the Websites for purposes other than those described in these Conditions.
Any use of the content for which Room00 Group has not expressly granted authorization, whether direct or indirect, with or without the intention of obtaining profit, including downloading, storing, transmitting, publicly disclosing, distributing, reproducing or transforming, reusing, or using scraping techniques, for private or commercial purposes, whether in whole or in part, shall be expressly prohibited. Room00 Group may take any legal or extrajudicial action it deems appropriate in the event of any infringement of its rights.

12. PERSONAL DATA PROTECTION
All personal data provided to Room00 Group in the context of the provision of the Services shall be processed in accordance with the Room00 Group Privacy Policy.
In the event that, for the contracting of the Services, the Customer is required to provide Room00 Group with the personal data of third-party individuals concerned, the Customer guarantees that they have lawfully obtained the consent (or any other applicable legal basis) from such data subjects for the processing of their personal data and for providing it to Room00 Group for the contracting and provision of the Services.
When the personal data of third parties concerns minors under 14 years of age, the Customer guarantees that they are the minor’s parent or legal guardian and therefore provide consent, or that, otherwise, they have obtained the express consent of the minor’s parent or legal guardian to process their personal data and provide it to Room00 Group for the contracting and provision of the Services.

13. LINKS TO THIRD PARTIES
The Websites may contain links to websites, applications, or similar content owned or operated by third parties. When the Customer clicks on such links and leaves the Websites, Room00 Group does not control and is not responsible for the third-party content accessed by the Customer. Room00 Group does not review, approve, or monitor such third-party content accessible through these links. The use of all third-party links by the Customer is carried out at their own responsibility and risk.

14. COMMERCIAL COMMUNICATIONS
As long as the Customer does not expressly withdraw their consent and throughout the term of the Conditions with the Customer, Room00 Group will send commercial communications to keep the Customer informed about all updates, as well as any type of information regarding Room00 Group or the services it provides that may be of interest to them.

15. COMPLAINTS
The User may submit a complaint by contacting Room00 Group through the email address administracion@room00group.com

16. MODIFICATIONS
Room00 Group reserves the right to modify these Conditions at any time. Changes or updates to the Conditions, as well as to the Privacy Policy, will be explicitly notified to the Customer through a notice on its Websites.

17. COMPETENT JURISDICTION
Given that Room00 Group is established in Spain, to the extent permitted by mandatory applicable legislation, the applicable law shall be Spanish common law.
Los tribunales competentes serán los correspondientes a la ciudad de Madrid. Lo anterior se entenderá sin perjuicio de la competencia judicial establecida en virtud de la norma imperativa, de los procedimientos extrajudiciales a los que las partes se sometan voluntariamente y de lo dispuesto en el apartado anterior de Reclamaciones.
